Leverage Your Advantage
All it takes is a single call or text to support a TCPA case. Even if someone consented to be called- even if you were compliant in every aspect of your operations- the consumer still has the right to sue you. They may not win, but the burden is on you to defend yourself in court. And whether you win, lose, or settle, that’s going to cost you money- sometimes a lot of money- which is why 9 out of 10 defendants write a settlement check and move on. TCPA predators know and rely on this simple fact- it is the engine that drives the entire industry.
Your one advantage? They need you to contact them. Otherwise, they can’t touch you. To leverage this advantage, we’ve spent years assembling a massive database comprised of the contact information of thousands of TCPA plaintiffs, attorneys, and associates. Each one of their numbers is a brick in our Litigation Firewall. Use our API to block their numbers from your outbound campaigns, and you will never give them the ammunition they need to attack you.
Designed from the ground up to counter common plaintiff tactics
A phone flipper maintains multiple prepaid cell phone numbers to receive calls intended for the person to whom the number was previously registered. This is a common tactic used to attract debt collection calls- some plaintiffs deliberately choose numbers from economically depressed regions.
A highly effective method in drawing calls, call baiting involves completing website contact forms with a correct phone number but a fake name (or the name of an accomplice). Plaintiffs often choose forms lacking compliant opt-in language.
Professional plaintiffs collect multiple calls before threatening legal action in order to maximize their damage claim. With a 4 year statute of limitations, many companies find themselves attempting to defend calls made years ago.
A version of call baiting, inbound seeding occurs when a company obtains consent to call a particular number. When the number is called, instead of answering, the plaintiff calls back from another phone, speaks to an agent, and then cuts the call short. The agent calls back the second number without first obtaining consent.
The corporate veil is a legal concept that protects corporate officers, directors, and shareholders from personal liability for the debts and other obligations of a corporate entity. To apply additional pressure to secure a quick settlement, plaintiffs often ignore the corporate veil and include individual officers, directors, and company owners as defendants.
